TERMS OF SERVICE
These Terms of Service ("Terms") govern your use of the Pursue mobile application and related services (the "App"). By creating an account, you accept these Terms.
1. ELIGIBILITY
You must be at least eighteen (18) years of age to use the App. If you are between thirteen (13) and seventeen (17), you may use the App only with parent or guardian consent and where permitted by local law. Use is void where prohibited.
2. YOUR ACCOUNT
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current information and to update it as needed. You may not impersonate another person, create accounts for someone else, or operate multiple accounts to manipulate leaderboards or rewards. We may suspend or terminate accounts that violate these Terms.
3. ACCEPTABLE USE
You agree not to:
- Use the App for any illegal purpose.
- Upload content that is fraudulent, misleading, defamatory, infringing, obscene, harassing, hateful, or violent.
- Impersonate any person or misrepresent your identity, age, or training history.
- Submit verification photos or videos that are not your own or that misrepresent your completion of a challenge.
- Use bots, scrapers, automated tools, or non-public APIs to access the App.
- Reverse engineer, decompile, or attempt to extract source code from the App.
- Interfere with the App's security, integrity, or performance.
- Manipulate calibration, verifications, friendships, or rewards through deceptive means.
- Use the App to harass, threaten, or harm other users.
We reserve the right to remove content and suspend or terminate accounts that violate these Terms.
4. USER CONTENT
You retain ownership of the content you upload — photos, videos, notes, biography, and so on. By uploading content, you grant Pursue a worldwide, non-exclusive, royalty-free, sublicensable license to host, copy, display, and distribute the content as necessary to operate the App and its features, including leaderboards, public profiles, and verification displays.
You represent and warrant that you have all rights necessary to upload the content and to grant this license, and that the content does not violate any third-party right or these Terms.
Objectionable content and abusive behavior are not tolerated. You may not post content that is unlawful, harassing, abusive, threatening, hateful, defamatory, obscene, sexually explicit, or that depicts or encourages violence or self-harm, and you may not abuse, harass, or stalk other users.
You can report content or block another user at any time from within the App — open the menu (the "..." control) on any post, comment, or profile. We review reports of objectionable content and act on them, typically within 24 hours, by removing the content and suspending or terminating the responsible account. We may also remove content or restrict accounts at our discretion to keep the community safe.
5. INTELLECTUAL PROPERTY
The App, including all design, code, text, branding, challenges, and other content not provided by users, is the property of Pursue and is protected by copyright, trademark, and other intellectual property laws. You receive a personal, non-transferable, revocable license to use the App for its intended purpose. You may not copy, modify, distribute, or create derivative works of the App or its content.
6. HEALTH AND SAFETY DISCLAIMER
The App provides fitness training challenges and information. It is not a medical service and does not provide medical advice, diagnosis, or treatment.
Before beginning any exercise program, including the challenges in this App, consult a qualified physician — particularly if you are pregnant, have a pre-existing condition, are recovering from injury, or have any cardiovascular, musculoskeletal, or other medical concern. Stop immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any unusual symptom.
You assume all risk of injury or harm from exercises performed in connection with the App. The challenges are suggestions, not prescriptions. Modify or skip any challenge that exceeds your ability or condition.
7. SUBSCRIPTIONS AND BILLING
Pursue offers an auto-renewing subscription, "Pursue Pro," that unlocks the App's full functionality.
- Pricing: $9.99 per month or $59.99 per year. The price shown at the time of purchase governs and may vary by region; applicable taxes may apply.
- Free trial: new subscribers may receive a 7-day free trial. If you do not cancel at least 24 hours before the trial ends, it automatically converts to a paid subscription and your Apple ID is charged.
- Auto-renewal: the subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
- Managing and canceling: payment is charged to your Apple ID. You can view, manage, or cancel your subscription and turn off auto-renew in your Apple ID settings (Settings → your name → Subscriptions). Deleting the App does not cancel your subscription.
- Refunds: purchases are processed by Apple and are subject to Apple's refund policy; we do not separately process refunds. Direct refund requests to Apple.
8. DISCLAIMERS
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES — THE FOREGOING EXCLUSIONS APPLY TO THE MAXIMUM EXTENT PERMITTED.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PURSUE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU HAVE PAID TO PURSUE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS ($100).
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
10. INDEMNIFICATION
You agree to indemnify and hold harmless Pursue and its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App, your content, or your violation of these Terms.
11. TERMINATION
You may terminate your account at any time through Me → Delete Account. We may suspend or terminate your access at any time, with or without notice, for any reason or no reason, including violation of these Terms. Sections that by their nature should survive termination — intellectual property, disclaimers, limitations, indemnification, governing law — will survive.
12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.
If you are a consumer resident in the EEA or UK, this clause does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.
13. CHANGES
We may update these Terms from time to time. Material changes will be notified through the App or by email. Continued use after the effective date constitutes acceptance.
14. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pursue regarding the App and supersede any prior agreements.
